Total Zero Verdicts for the Workers' Compensation Team
We are proud to announce that George F. Klauke received a total zero verdict in the case of Austin v. Mother Theresa. Petitioner alleged two accidents. The first case was with a different company whose case was dismissed and never reinstated. We successfully defended the second injury, proving Petitioner did not have an accident or aggravation on the day alleged. Congratulations are also in order for Marc J. Cairo, who claimed a total zero verdict in the case of Maxima Abaschal v. Medline Industries. Petitioner claimed injuries to her arm when she struck it on a doorknob while entering the company locker room. Initially the claim was accepted and medical bills were paid; thereafter a dispute arose over $13,000.00 in chiropractic bills. At the time of trial, we placed "accident" into dispute. The Arbitrator signed our Proposed Decision and found that Petitioner failed to prove her injuries arose out of her employment and denied all requests for compensation. Additionally, in September the Commission affirmed the Arbitrator's decision that Petitioner did not sustain compensable work injuries when he was shot in the face by his own sidearm while employed as a security officer in Kelley v. United Security. The Commission agreed with the Arbitrator and our defense that Petitioner's injuries were the result of "horseplay" and affirmed the denial of Compensation under the Illinois Workers' Compensation Act. This case is currently on review before the Circuit Court.
