Emmit Kelley v. Illinois Workers' Compensation Commision and United Security Services
The firm successfully defended a workers' compensation claim filed by a security officer who suffered a gunshot wound to his head in Emmit Kelley v. Illinois Workers’ Compensation Commission and United Security Services, Non-published, Rule 23 Order, First District Appellate Court (March 13, 2007). Claimant (security guard) sought benefits under the Illinois Workers' Compensation Act for injuries to his head when he was shot in the face. The firm successfully argued that the injuries were the result of the claimant's horseplay and thus not compensable. The defense was successful at all levels and affirmed by the Appellate Court First District in a unanimous decision. There are no other cases in this state where a security officer has been denied workers' compensation benefits for gunshot wounds.
